TERMS & CONDITIONS (Terms of Service)
1.1. Who we are
The Daily Mulligan is a golf news and entertainment service available via our website and mobile apps (the "Service"). The Service is operated by Bright Sky Apps Ltd, a privately held limited company registered in Scotland, UK (company number SC390778), with registered office at 27 Victoria Street, Carnoustie, Angus, Scotland, DD7 7LW ("we", "us", "our"). 1.2. Agreement to these Terms
By accessing or using the Service, creating an account, or purchasing a subscription or membership, you agree to be bound by these Terms & Conditions (the "Terms") and our Privacy Policy. If you do not agree, do not use the Service.
1.3. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent. You are responsible for ensuring you have the legal capacity to enter into these Terms in your jurisdiction.
1.4. Accounts and Security
- You may create an account using your email address (which we use as your primary identifier).
- Keep your credentials confidential and secure. You are responsible for all activity under your account.
- We may require multi-factor authentication.
- Notify us immediately of any unauthorised use or security incident.
1.5. Content & Editorial Transparency
- Human-edited content with AI assistance: All articles are edited and published by humans. AI tools may assist our editors and writers.
- Humour first: Our articles prioritise humour and entertainment. Articles may be accurate but are not guaranteed to be factual and should not be relied upon as authoritative or professional advice (see Disclaimers).
- Images: All images are created by us. We do not intentionally depict known persons. If an image resembles a celebrity or other known person, this is coincidental resemblance, not a true image.
- User-generated content: You may be able to post comments or other user content. You remain responsible for your submissions and must ensure you have the right to share them.
1.6. Community Standards (Zero-Tolerance Policy)
We expect respectful, civil behaviour at all times. You must not:
- harass, bully, demean, or use inflammatory language toward others;
- post hateful, racist, sexist, homophobic, or otherwise discriminatory content;
- incite violence, doxx, or threaten anyone;
- post illegal content, defamation, or content that infringes third-party rights;
- spam, manipulate engagement, or run unauthorised promotions.
We have a zero-tolerance policy for breaches. All reports of non-adherence will be investigated and necessary actions taken, which may include content removal, account suspension or termination (see 1.12).
1.7. Subscriptions, Founding Memberships & Fees
- Subscriptions: We offer monthly and annual premium subscriptions ("Subscriptions") that unlock premium features and an ad-light experience (as described in-app).
- Founding Member Membership: We may offer a one-time Founding Member fee that provides lifetime access to premium features at no further subscription charge. This tier is limited to 1,000 members. Founding Member status is personal, non-transferable, and may be withdrawn for cause (e.g., serious breach of these Terms) without refund, to protect the community.
- Price changes: Subscription fees are subject to change at our discretion. Where required by law or platform rules, we will give prior notice and/or provide options to cancel before changes take effect.
- Where you pay: Subscriptions on iOS and Android are managed by Apple App Store and Google Play respectively. Payments on web are processed by Stripe.
- Trials & promos: We may offer promotions, contests, or sweepstakes periodically (see 1.10).
- Taxes: Prices may exclude applicable taxes, which will be added where required.
1.8. Billing, Renewal, Cancellation & Refunds
- Auto-renewal: Subscriptions generally auto-renew unless cancelled at least 24 hours before the end of the current period (subject to app store rules).
- How to cancel: For in-app purchases, manage/cancel via your Apple or Google account settings. Web purchases can be managed via your account settings or by contacting support.
- Refunds: Refunds for purchases through Apple or Google are governed by their respective store policies; we cannot override those decisions. For Stripe web purchases, contact us at [email protected].
- Failed payments: We may suspend or downgrade access until payment issues are resolved.
1.9. Advertising & Third-Party Services
- Free tier advertising: The app uses AdMob and the website uses AdSense for advertising to free-tier users. You may see personalised or contextual ads depending on your consent choices (see Privacy & Cookies).
- Analytics & crash reporting: We use Google Analytics, Firebase, Sentry, and OpenPanel to understand usage and improve stability (see Privacy Policy).
- Your use of app stores, Stripe, and other third-party services may be governed by their own terms.
1.10. Promotions, Contests & Sweepstakes
We may run promotions, contests, or sweepstakes. Official Rules will accompany each promotion and will govern eligibility, entry methods, prizes, and any additional terms. In case of conflict, the Official Rules prevail over these Terms for that promotion.
1.11. Intellectual Property
- The Service, including all content, trademarks, logos, artworks, and software, is the intellectual property of Bright Sky Apps Ltd or our licensors and is protected by UK and international laws.
- You may view and use the Service for personal, non-commercial purposes only.
- Except as permitted by law, you must not copy, modify, reverse-engineer, distribute, or create derivative works without our prior written consent.
- You grant us a worldwide, royalty-free licence to use, reproduce, modify, and display any user content you submit (e.g., comments) for operating and promoting the Service.
1.12. Moderation, Suspension & Termination
We may remove content, restrict features, suspend, or terminate accounts at our discretion for violations of these Terms, applicable law, or community standards, or to protect users. Founding Member status may be withdrawn for serious breach without refund. We may preserve information where required by law or to enforce our rights.
1.13. Software Licence
We grant you a limited, revocable, non-exclusive, non-transferable licence to use our apps and website in accordance with these Terms. We reserve all other rights.
1.14. Disclaimers
- Entertainment only: Content is provided for entertainment. While we aim for accuracy, articles are edited for humour and may not be factual. Do not rely on content as advice.
- No warranty: The Service is provided "as is" and "as available." We and our suppliers disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
- Third-party services: We are not responsible for third-party content, services, or links.
1.15. Limitation of Liability
To the maximum extent permitted by law, we (and our directors, officers, employees, and suppliers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. Our total aggregate liability for all claims relating to the Service shall not exceed the greater of £50 or the amount you paid to us in the 12 months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under law (e.g., death/personal injury caused by negligence, fraud).
1.16. Indemnity
You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your breach of these Terms, your content, or your misuse of the Service.
1.17. Changes to the Service or Terms
We may update the Service and these Terms from time to time. Material changes will be notified via the app, website, or email. Continued use after changes take effect constitutes acceptance.
1.18. Governing Law, Venue & Dispute Resolution
- These Terms and any non-contractual obligations are governed by the laws of Scotland.
- Venue: The courts of Scotland shall have exclusive jurisdiction, subject to any mandatory consumer protection rules.
- Arbitration (optional): At our election or with mutual agreement, disputes may be referred to binding arbitration in Scotland under the Arbitration (Scotland) Act 2010. Any arbitration will be conducted in English. You and we waive any right to a jury trial where applicable.
- Class/representative actions: To the extent permitted by law, disputes must be brought in an individual capacity, not as a class/representative action.
1.19. Miscellaneous
- Severability: If any provision is found invalid, the remainder remains in effect.
- Assignment: You may not assign your rights without our consent. We may assign as part of a reorganisation, merger, or sale.
- Force majeure: We are not liable for delays or failures due to events beyond our reasonable control.
- Entire agreement: These Terms, the Privacy Policy, and any promotion-specific rules constitute the entire agreement between you and us.
